Last reviewed: October 27, 2026Next review due: January 2027

Key takeaways

Prince Edward Island prohibits selling or supplying tobacco or an electronic smoking device to anyone under 21. Flavoured products are banned, and devices may only be sold in tobacconist shops. The Smoke-free Places Act bans smoking in public places and workplaces and in a vehicle with anyone under 19. Provincial tax is 30 cents per cigarette, or $60 per carton.

As of 27 October 2026, Prince Edward Island has the highest tobacco and vaping age we have confirmed in any province: 21. Anyone who sells or supplies tobacco or an electronic smoking device to a person under 21 breaks the Tobacco and Electronic Smoking Device Sales and Access Act. Provincial tax is $60 per carton of 200.

Twenty-one, for tobacco and electronic smoking devices alike. The Act also bars buying them on behalf of, or for resale to, someone under 21. It is not a defence that the buyer looked 21 or older, and a seller facing someone who appears under 21 must see ID first. The regulations accept three kinds: a driver’s licence issued by a government authority, a passport, or other government-issued ID showing a photograph and date of birth. Neighbouring Nova Scotia and New Brunswick use 19. Compare all provinces in the legal smoking age guide and legal vaping age by province.

Which laws apply?

Three Acts cover most of it. The Tobacco and Electronic Smoking Device Sales and Access Act (R.S.P.E.I. 1988, Cap. T-3.1) governs sales, flavours, display and age; its government consolidation is current to 1 February 2025. The Smoke-free Places Act (Cap. S-4.2) governs where smoking is allowed. The Tobacco Tax Act sets the tax.

Where are smoking and vaping banned?

Under the Smoke-free Places Act, “smoke” includes operating an electronic smoking device or waterpipe, so the same rules cover vaping. People may not smoke in a public place or workplace, and a patio (an outdoor area run with an eating establishment or licensed premises) cannot be made a designated smoking area except during hours set by regulation. In a motor vehicle, smoking is banned while anyone under 19 is present, window open or not. A contravention carries a fine of $100 to $2,000.

The only copy of the Act posted on the province’s site is an office consolidation current to 11 August 2018, so later amendments may exist. We did not find distances from doors or playground rules on any page we could read.

What are the retail rules?

  • Vapes only in tobacconist shops: no one may sell an electronic smoking device except in a tobacconist shop.
  • Designated places: neither tobacco nor devices may be sold in hospitals, pharmacies, government, municipal and school buildings, theatres, video arcades, amusement parks, or recreation facilities.
  • Display: tobacco and devices may not be displayed in retail settings, countertop and wall displays included, apart from tobacconist shops on stated conditions.
  • Flavours: selling a product that contains a prescribed flavouring agent is prohibited. The regulations define that as any agent giving an aroma or taste other than tobacco, including fruit, candy, chocolate, vanilla, menthol and other cooling agents. The Council of Chief Medical Officers of Health lists PEI among jurisdictions that ban all flavoured nicotine vaping products. See vape flavour bans by province.
  • Nicotine cap: the regulations set a maximum of 20 mg/mL.
  • Penalties: fines for breaches such as selling to a person under 21 start at $1,000 for an individual and $5,000 for a corporation, rising to $5,000 and $25,000 for a third offence.

How much is the tobacco tax?

30 cents per cigarette and per tobacco stick under the Tobacco Tax Act (consolidation current to 29 May 2026), which makes $60.00 per carton of 200. Other tobacco is taxed at 40 cents per gram and cigars at 75% of the retail price. Federal excise adds $38.92 per carton, so government tax is $98.92 before sales tax. We could not confirm from an official page when the 30-cent rate took effect. See tobacco tax rates in Canada.

Where can you get help to quit?

The PEI Smoking Cessation Program covers one 12-week course per year of nicotine replacement (gum, lozenges, inhalers or patches) or a prescription quit medication (bupropion or varenicline) for residents ready to quit, through an appointment with a nurse at a primary care network office. The brochure is undated. Health Canada’s national line, 1-866-366-3667, connects to a quit coach. See free quit-smoking help by province.

How does PEI differ from its neighbours?

PEI is two years above Nova Scotia on age (21 against 19) and the only one of the two that confines vape sales to tobacconist shops in the sources we read. Tax is close: $60.00 here, $59.04 in Nova Scotia.
