The Non-Smokers' Rights Association/Smoking and Health Action Foundation has a searchable database of smoke-free laws across Canada. The database shows bylaws and laws that go beyond the Smoke-Free Ontario Act (SFOA) on second-hand smoke or e-cigarettes.

It does not cover other tobacco control issues like flavoured tobacco or advertising.

Note about the Smoke-Free Ontario Act (SFOA)

Bill 174, which enacts the Cannabis Act, the Ontario Cannabis Retail Corporation Act and the Smoke-Free Ontario Act, was introduced on 1 November 2017 and received Royal Assent on 12 December 2017. The new SFOA will come into effect on 1 April 2018.

“Leading Edge” Standards for Smoke-Free Laws and Bylaws

Some database entries are listed as “leading edge.” What is “leading edge”?

This database highlights laws and bylaws with new elements. There is no consensus on what “best practices” or “gold standard” means, so we gathered our public health partners to discuss what would constitute “leading edge.”

Based on these discussions and other input, we came up with a list of outdoor spaces where, by banning smoking there, a municipality/province/territory is setting an example for the rest of the country. A bylaw or law can also be considered leading edge if it bans the use of certain devices or substances, whether indoors or outdoors.

We know that “leading edge” is not fixed. As social policy changes in Canada, laws and bylaws will be re-evaluated.
