The bylaw prohibits smoking and the use of smokeless tobacco in public parks, sports fields and outdoor recreation facilities and within 9 metres of a transit stop or any entrance of buildings operated by the Town. There is no mention of air intakes or operable windows in the bylaw. By virtue of the definitions used, smoking includes the use of waterpipes and electronic cigarettes. Note that, while the Town’s bylaw allows for smoking in parking lots, the amended SFOA will restrict smoking if that area is within 20 metres of a recreational field.

Definitions

“Public place” shall mean the parks, sports fields and recreational facilities listed in Schedule A, whether or not a “No Smoking” sign is posted. “Smoking” means the carrying of a lighted cigar, cigarette, pipe, or any other lighted or heated smoking equipment used to smoke or vaporize any tobacco or non-tobacco substance. “Use of Smokeless Tobacco” shall mean the use of chew, plugs, snus or snuff.

Policy Analysis

This is a leading edge bylaw because it prohibits the use of smokeless tobacco, waterpipes and electronic cigarettes outdoors. What would strengthen the bylaw would be to prohibit the use of these products indoors as well. Named properties listed in an appendix to a bylaw are not recommended as it requires a bylaw amendment if one of the names of the properties is changed or if a new property is added.
